General Conditions of Sale (GCS) – EMMANUEL MARY architect +
Article 1 – Purpose
These General Terms and Conditions of Sale (GTCS) define the rights and obligations of the parties regarding the services provided by EMMANUEL MARY architecte +. They apply to all architectural, consulting, and technical audit services performed on behalf of clients.
Article 2 – Services
2.1 Architectural Services
The architect provides full or partial services, including:
• Architectural design (concept sketches, preliminary design, building permit applications).
• Supervision of construction and coordination of contractors.
• Renovation and rehabilitation.
• New construction projects.
• Compliance upgrades for public-access buildings (ERP) and collective housing.
2.2 Audit and Technical Studies
In addition to standard architectural services, the architect also offers audit and technical study services, including:
• Technical audit of commercial buildings: assessment of the building’s condition and identification of necessary renovations.
• Compliance analysis with accessibility (PMR) and thermal regulations: evaluation of installations and recommendations for compliance.
• Architectural and regulatory feasibility study: assessment of a property’s potential based on urban planning regulations and technical constraints.
• Transaction analysis of a property: guidance for buyers or sellers before acquisition or sale.
Commitments and Limitations
These services are conducted based on the documents and access provided by the client.
The architect is committed to delivering an objective and well-supported analysis but cannot be held responsible for regulatory changes occurring after the audit or for administrative decisions beyond their control.
Terms and Pricing
Audits, studies, and sketches are carried out based on a prior quote, determined according to the complexity of the property and the required level of analysis. A deposit may be required before any intervention. Each project or study will be preceded by the drafting of a contract.
Article 3 – Fees and Payment Terms
Fees are determined based on the nature and scope of the project and are specified in a written agreement between the architect and the client. Payments are made according to the schedule detailed in the contract, with an initial deposit required upon signing.
Article 4 – Liability and Insurance
The architect holds professional insurance for the services provided. The architect cannot be held liable for non-compliance by the client or for external events beyond their control.
Article 5 – Applicable Law and Disputes
Any dispute related to the execution of services will be subject to French law and, in case of persistent disagreement, to the competent courts.
